The following Privacy Statement (“the Agreement”) discusses the information collected by SYMACK Corporation (“SYMACK”) including SYMACK affiliates collectively (“SYMACK Corporation, SYMACK Professional Services (Canada) Corporation, SYMACK Professional Services (US) Corporation, SYMACK Capital (Canada) Corporation, SYMACK Capital (US) Corporation, SYMACK Capital Management (Canada) Corporation, SYMACK Capital Management (US) Corporation and SYMACK Labs Corporation”) about you (“the User”) when accessing the SYMACK website, products or services, and what SYMACK uses that information for. Within the Agreement we also discuss the User’s rights in relation to the gathered information and who the User can contact for additional information or queries.
For the sake of the Agreement the set of web-pages accessed by the User collectively will be referred to as (“Website”), any applications accessed using mobile devices (ie, phones, tablets) will be referred to as (“Mobile Apps”), and lastly any newsletters, case-studies, white-papers downloaded by the User onto their device(s) will be referred to as (“Communication”).
By accessing or using this website including any communications or products and services offered by SYMACK, the User acknowledges that they have read, understood, and agreed to be bound by the terms included in the Agreement, and will comply with all applicable laws and regulations. The agreement also applies to personal information that SYMACK may collect to support marketing insights and/or activities. If there is any sections of the Agreement at whole or in part that the User does not agree with, please do not continue to use the SYMACK website.
Without prior notice to the User, SYMACK may revise the content within the Agreement as well as information contained within this website at its own discretion. SYMACK may also make improvements or changes to the various Programs, Services, and/or Products described in this site at any time and without notice to the User.
At SYMACK we acknowledge the importance of protecting gathered User information and are committed to processing the information responsibly and compliant with the applicable data protection laws in countries that SYMACK operates in. Within this Agreement SYMACK describes the general privacy practices applied to the User information SYMACK gathers, processes, and/or share with third-party business partners, suppliers and organizations that SYMACK conducts business with. The Agreement is supplemented by the SYMACK Online Privacy Statement that provides additional information regarding User information gathered by SYMACK’s online services and recruiting processes. SYMACK may provide additional and more specific policies regarding the collection and processing of User information specific to the individual Websites, Communications, Products or Services offered by SYMACK. As part of the Agreement, User Information gathered and processed by SYMACK referred to as (“User Information”). Also as part of the Agreement references to collecting, protecting and managing of User Information would be described as (“Processing”). As part of the Agreement SYMACK is not subject to the requirements of the California Consumer Privacy Act.
Please note that the additional regional websites contained within https://www.symack.com are provided as affiliates within the SYMACK Network and are not provided by SYMACK.
Websites of SYMACK affiliates, as well as other websites that may be linked to the SYMACK website, are not governed by this privacy statement. SYMACK encourages visitors to review the separate privacy statements for those websites prior to accessing any of the pages or communications contained within those websites. As part of this Agreement SYMACK provides information regarding when SYMACK would share User information with affiliates within the SYMACK Network as well as third-party partners.
SYMACK may from time-to-time apply modifications or amendments to the Agreement. The revised Agreement will be posted on the SYMACK website with an updated revision date indicated within this page. The newly modified or amended Agreement will apply from the revision date. SYMACK encourages Users to check back periodically to remain updated with any changes or updates to the Agreement and the steps SYMACK is taking to protect the User’s information.
SYMACK may collect User information for various purposes:
- When accessing one of SYMACK’s websites or using an online service provided by SYMACK service, SYMACK will record the User Information necessary to provide the User with access, and for the proper operation of the SYMACK website and for SYMACK to comply with legal requirements and the securing of the User experience to facilitate proper operation(s) of SYMACK websites and services. Such User information may include IP addresses, User Credential and Browser Settings. SYMACK may also collect information about the User’s activities while accessing SYMACK websites and services in order to personalize the User’s experience based on recorded preferences and User settings. In addition to the collection of User information required for SYMACK to compile statistical and marketing data to further develop and improve SYMACK websites and services.
- When granting Users with access to SYMACK websites, products or services. And to enable SYMACK to provide support required by the SYMACK websites, products or services. SYMACK will also collect User information in order to build a profile of the User enabling Users to contact SYMACK to request additional information regarding SYMACK’s products or services, or to allow Users to participate in forums and social networking services provided by SYMACK. In short, SYMACK will collect your User Information (ie, name, contact, request details) as well as agreement related information in order for SYMACK to deliver and invoice the User. SYMACK may also collect data to assist in determining client’s satisfaction with the SYMACK website, products or services.
- When Users provide User Information to register with SYMACK’s websites, products and services, the User Information collected during registration may serve SYMACK to identify Users when Users visit SYMACK websites. And to assist Users attempting to order products and services from SYMACK. User information collected during registration may also be used to enable Users to customize and control User privacy settings.
- SYMACK will collect User information when establishing relationships with SYMACK prospects/clients, partners and suppliers. SYMACK may collect information required to conduct business operations such as business name, contact details, position or titles, and authorized users for the drafting and management of contract(s), delivery of products, and fulfillment of services, provisioning of support for SYMACK products or services, invoicing, and overall management of client relationships.
- SYMACK will register User Information of Users visiting SYMACK’s websites such as name, certain identifications, contact information and the use of camera supervision for the reasons of security and safety of Users interacting with SYMACK websites, product or services and for regulatory purposes.
- The information SYMACK may collect about Users will come from direct interactions between SYMACK and Users through the SYMACK website, products or services. When Users register, access or interact with an event led by SYMACK, its affiliates, partners directly or in-directly SYMACK may collect User information online or offline during the event for the purpose or information gathering for processing or survey purposes. SYMACK will combine gathered User information to develop aggregated analysis and business intelligence or analytics for the purpose of conducting our business operations and/or for marketing purposes.
When interacting or using SYMACK websites, product or services SYMACK may the User with personalizations in the form of information and communications. The User may always opt-out from receiving the personalized information and communication from SYMACK by submitting an opt-out request to SYMACK using the Contact Us Form. For subscriptions based products and services, the User will need to follow the unsubscribe instructions provided at the bottom of the page/communication/email.
References within the Agreement in regards to the gathering of User information by SYMACK are initiated by the User once accessing SYMACK websites and communications or when the User requests additional information regarding SYMACK products or services. SYMACK also gathers User Information to draft orders or agreements required to provide Users with product or services offered by SYMACK. SYMACK collect As part of the Agreement, the User acknowledges and understands that SYMACK will collect User Information as deemed necessary and required by SYMACK to improve SYMACK’s ability to deliver websites, communications, products and services to Users.
References within the Agreement in regards to the processing of User Information by SYMACK, affiliates and third-party partners to assist in the marketing and enhancement of SYMACK websites, communications, products and services and is done so to provide Users with a safe, secure and regulatory compliant requirements experience. As part of the Agreement SYMACK, the User acknowledges and understands that SYMACK will collect User Information on the basis that SYMACK, affiliates or third party partners does so for legitimate interests and consent of the User.
As part of the Agreement, Users acknowledge that SYMACK collecting and processing User information subject to the EU Privacy Legislation may have consequences to the User rights. The User can request information collected by SYMACK by sending a request to SYMACK using the Contact Us Form.
For details regarding the technologies SYMACK employs when collecting User Information such as the type of information we collect, as well as how SYMACK leverages technologies to control, block, track or delete cookies, please refer the SYMACK Online Privacy Statement.
At SYMACK we have an ongoing obligation to protect User information gathered by SYMACK’s Websites, Programs and Services and to maintain its accuracy. For this reason, SYMACK has implemented administrative and technical measures in order to safeguard User information from unauthorized and malicious use and disclosure. For example SYMACK encrypts and tokenize certain sensitive information such as credit card transmitted over the Internet. SYMACK also requires its suppliers to adhere to the same strict measures to protect such information from unauthorized access and malicious use.
Such measures also include:
- The administering of access controls in order to limit and restrict access to the User information.
- The physical limitation measures through the use of security passes for SYMACK and third-party staff.
- The educating and training of SYMACK staff to ensure they are made aware of SYMACK’s privacy obligations.
- The application of technological and security principals including the implementation of firewall rules, encryption, tokenization and anti-virus software.
As much as SYMACK values the sensitive nature of User information, once such is transmitted over over the internet (including e-mails), SYMACK cannot guarantee the complete securing and safeguarding of the data. As discussed, SYMACK has an obligation to protect User data to the best of our ability however, SYMACK cannot guarantee the security of data transmitted to SYMACK or by SYMACK over the internet.
SYMACK offers a wide range of products and services globally that operate under a set of management structures, business processes, and technical infrastructure spanning multiple geographic locations. To manage the complex and distributed nature of the organization, SYMACK has implemented strict policies, standards and procedures when it comes to the safeguarding of User information. As part of the Agreement SYMACK agrees to only share User information with our subsidiaries globally and transfer User information to countries where SYMACK conducts business and in accordance with this Privacy Statement. As part of the Agreement User understands that SYMACK may share gathered User information between SYMACK affiliates that require access to the User information and on a need-to-know basis in-line with SYMACK knowledge sharing and retention policies, standards and procedures.
There may be cases where SYMACK leverages partners located in various countries to collect, use, analyze and process User information on behalf of SYMACK’s partners. As part of the Agreement the User understand that SYMACK may be required to User information with selected partners to assist SYMACK with providing Users with products or services that they may be interested in. When selecting suppliers and partners, SYMACK takes into account the potential partner’s data handling and retention processes.
In the case that SYMACK decides to buy, sell, merge or otherwise reorganize with businesses located in other countries, such effort may involve the disclosing of User information to prospecting or actual purchasers as well as prospecting or actual sellers. It is SYMACK’s standard practice to enforce the appropriate protection of User information during such transactions to combat against data leaks and exploitation.
As part of the Agreement the User understands that SYMACK may share User information to protect SYMACK’s rights or property, as well as the rights or property of SYMACK’s partners, suppliers or clients, as well as third-parties when SYMACK has reasons to believe that such rights or property have been or could potentially be affected. As part of the Agreement the user is aware that in certain circumstances, SYMACK may be required to disclose User information to competent authorities including government agencies, courts and regulatory bodies. As part of this Agreement the User understand that SYMACK may share non-personal, masked and aggregated User information with third-parties for purposes including business intelligent, data analytics and promotional purposes.
Please note that some of the recipients that SYMACK may disclose User information to may be based in regions outside of the European Union (“EU”) and whose laws may not provide the same level of data protection as the EU. In such cases, SYMACK will ensure adequate safeguards are put in place to protect User information shared by SYMACK and that the safeguards comply with SYMACK’s information management policies and legal obligations. Such safeguards may actually be governed by data transfer agreements between SYMACK and the recipient which are based on approved contractual clauses as defined by the EU Commission for the transfers of User and sensitive information.
SYMACK may host various blogs, forums, wikis which allows Users to share content with other users (“Social Networking Applications”), as a result and as part of the Agreement, the User agrees that any information that the User contributes to the Social Networking Applications can be accessed, collected and used by other Users of the application. Within such Social Networking Applications, SYMACK has little to no control over Users accessing such applications and therefore, SYMACK cannot guarantee the handling of User information within Social Networking Applications in accordance with the Agreement and SYMACK’s Information Management policies.
You the User have various rights in relation to the information SYMACK may gather. More specifically, Users have the right to:
- Obtain confirmation that SYMACK is processing User information, and request a copy of the information SYMACK may have about the User.
- Request SYMACK to make modifications to User information that SYMACK may hold about the User in the verified event that the User information gathered is not complete or erroneous.
- Request that SYMACK delete the information that SYMACK may hold about the User, and/or restrict the way SYMACK uses the information.
- Submit objections or complaints regarding the information about the User that SYMACK may gather and/or process.

If the User has any questions related to the Agreement, please fill out the Contact Us Form . The User’s message will be forwarded to the Data Protection Officers or appropriate members at the SYMACK Data Privacy Team.As part of the Agreement and where relevant, and unless indicated otherwise, the controller of User’s personal information is SYMACK Corporation, 115 George St. Suite 140, Oakville ON L6J 0A2. Where SYMACK or affiliate is not established in the European Economic Area (EEA).
SYMACK is not the controller of User private information in situations where:
- The personal information gathered or processed is a result of entering into a contractual relationship with a specific SYMACK affiliate. The controller of User’s personal information in such cases are the SYMACK contracting companies, the legal entity of which the User or the User’s will or has the contract with directly.
- The personal information is collected using a website belonging to one of SYMACK’s affiliates. In such cases the SYMACK affiliate is the controller of the User’s personal information.
