The following Online Privacy Statement (“the Agreement”) discloses how information collected by SYMACK Corporation (“SYMACK”) including SYMACK affiliates collectively (“SYMACK Corporation, SYMACK Professional Services (Canada) Corporation, SYMACK Professional Services (US) Corporation, SYMACK Capital (Canada) Corporation, SYMACK Capital (US) Corporation, SYMACK Capital Management (Canada) Corporation, SYMACK Capital Management (US) Corporation and SYMACK Labs Corporation”) about you (“the User”) is used when accessing SYMACK Websites, Communications, Products or Services. Within the Agreement we discuss how Cookies, Web Beacons and other technologies may be used by SYMACK’s Websites, Communications, Product or Service Offerings. References to SYMACK’s Websites, Communications, Products and Services within the Agreement include content accessed using Apps, Programs, Desktop and Mobile Devices. Also covered as part of the Agreement is what SYMACK uses gathered User information for.For the purpose of the Agreement the set of Web-Pages accessed by the User collectively will be referred to as (“Website”), any applications accessed using mobile devices (ie, phones, tablets) will be referred to as (“Mobile Apps”), and lastly any Newsletters, Case-Studies, White-Papers downloaded by the User onto their device(s) will be referred to as (“Communication”).The SYMACK Online Privacy Statement supplements the SYMACK Privacy Statement as well as any Privacy Statements made available by SYMACK Websites, Communications, Products and Services.
When Users (i) access the SYMACK site, (ii) download Communications onto their Desktop and/or Mobile Devices, (iii) submit inquiries to SYMACK requesting information, or (iv) enrol into the different SYMACK Products and Service Offerings, SYMACK may ask the User to provide their name, business contact information, as well as supplemental information depending on the request. SYMACK will use the information to associate and identify the User to the request and allow for interactions between SYMACK and the User to take place. SYMACK will retain the gathered User information for potential future interactions between SYMACK and the User. If the User would like SYMACK not to process the gathered User information, please notify SYMACK using the Contact Us Form.
SYMACK may also require Users to register a SYMACK User ID, which requires the User to provide SYMACK with their Name, Address Information, Title, Organization, Email, as well as additional information for the purpose of delivering SYMACK Communications, Products or Services to the User. SYMACK assigned User IDs are meant to uniquely identify Users when visiting the SYMACK websites or when requesting the various Communications, Products or Services offered by SYMACK. When ordering product or services from SYMACK, Users will be required to register accordingly and have a unique SYMACK User ID assigned to the User. By assigning the User with a SYMACK User ID, SYMACK will be able to customize and control the User’s privacy settings and how SYMACK processes the gathered User information.
By accessing or using the SYMACK website as well as any SYMACK communications, products and services offerings, the User acknowledges that they have read, understood, and agreed to be bound by the terms included in the Agreement, and will comply with all applicable laws and regulations. The agreement also applies to the personal User information that SYMACK may collect to support marketing insights and/or activities. If there are any sections of the Agreement as a whole or in part that the User does not agree with, please do not continue to use the SYMACK Website, Communications, Products or Services.
SYMACK’s Privacy Practice when gathering User information using SYMACK Websites, Communications, Products and Services as describe in the Agreement are in the process of being compliant with the APEC Cross Border Privacy Rules (CBPR) System. Effective the date of the Agreement, SYMACK is working with a vendor to ensure proper compliance with APEC’s CBPR System. The APEC CBPR System provides a framework for organizations to ensure the protection of personal and sensitive User information when transferred among APEC participating regions. Please visit the APEC CBPR System site for additional information regarding the framework.
If you the User has any questions or complaints regarding SYMACK’s Data Privacy and Retention Policies and Practices, please contact SYMACK using the Contact Us form. For unresolved Privacy or Data Protection concerns that have not been addressed to the User’s satisfaction, please contact SYMACK’s third party dispute resolution provider TRUSTe using the TRUSTe Feedback and Resolution System
As part of this Agreement the User acknowledges that SYMACK reserves the right to retain and process User information gathered by SYMACK’s Websites, Communications, Products and Services, as well as User Information submitted by the User while attending a SYMACK fully and/or partially sponsored Event for as long as required to fulfill the purpose the information was gathered for or for valid reasons as defined by the Agreement and that requires SYMACK to retain the User’s personal information to enhance SYMACK’s ability to deliver services to clients, for the protections of SYMACK’s Assets and Intellectual Property, Comply with Legal Obligations, Resolve Disputes, and/or Enforce SYMACK’s Agreements.As part of the Agreement, the User acknowledges that any information submitted by the User during the registration to SYMACK Products, Services Offerings and/or Events will be retained by SYMACK under this Agreement and for as long as the User account with SYMACK is active.
If the User wishes to withdraw their registration from SYMACK Products, Services Offerings and/or Events, the User is urged to contact SYMACK using the Contact Us form. In regards to SYMACK Products and Services that are authorized under a contract between SYMACK and the User, the User registration and billing information will be retained to fulfill the terms of the contract agreed upon by SYMACK and the User.
SYMACK may collect User information relating to the User’s use and interaction with the SYMACK Website and Cloud based products and services. The User information gathering and processing will be done using various in-house technologies developed by SYMACK as well as third-party technologies. For example, when the User visits a SYMACK Websites or access SYMACK’s Cloud based services, SYMACK may process certain information sent using the User’s browser such as the (i) User’s IP Address, which will include the User’s geographic or geo-location information; (ii) browser type; (iii) Time and Duration of the access; (iii) Language Preference; (iv) the SYMACK website pages viewed and actions performed by the User during their visit. When Users access the SYMACK website anonymously or without a SYMACK ID, SYMACK will still collect User information in order to enable the Websites to function properly.
In addition to SYMACK’s cloud based services, some of SYMACK’s products or service offerings leverage technologies that collect information about how Users interact with SYMACK products or services. SYMACK may also use technologies to determine if Users open emails sent by SYMACK and clicked on links contained within the e-mails. For additional details regarding the technologies leveraged by SYMACK to collect and process User information please refer to the Cookies and Technologies section of the Agreement.
SYMACK provides Social Media and Social Media Integration services as part of SYMACK Websites, Communications, Product and Services. The Social Media services are developed by SYMACK to enable the online sharing and collaboration of SYMACK Website material, Communications, Products and Services among professionals within various industries. The Social Media services include Online Forums, Wikis, Blogs as well as third party Social Media platforms. When Users download and interact with the SYMACK and third party Social Media services, the User may be asked to provide private and sensitive information regarding the User. All User information gathered during registration by SYMACK will be subject to and protected in accordance with the Agreement. User information that is not protected as part of the Agreement is information that is (i) made available to other participants automatically as part of the Social Media service and as part of the User’s profile, and (ii) information that is publicly shared by the User at their own will within the Social Media service.
Social Media services offered by SYMACK and third-party vendors may include their own Privacy Statement(s) that cover the collection and handling of User Information, and that will supplement the Agreement. We at SYMACK encourage Users to ready and make sure they understand and and all supplemental statements in order to understand what information is collected by the Social Media services and how that information is processed.
As part of the Agreement, Users agree that any and all content share by the User, irregardless or the nature of the material (ie, professional and non-professional), including and not limited to images, written content, opinions of any sort, and/or personal information of any sort is the sole responsibility of the User, SYMACK does not share an opinion nor does SYMACK agree/disagree with the content made public by the User on SYMACK and/or third-party Social Media service. As part of the Agreement the user also accepts that information made public by the User as described in the paragraph above is not and will not be subject to the Agreement.
Content and information as described in the paragraph above made public by the User using SYMACK’s or third-party Social Media services is subject to the Terms of Use of the Social Media services used, as well as any additional or supplemental guidelines and privacy information provided as part of those services and their use. Also included in those Terms of Use and Privacy Terms are the steps or process required by Users that would like to remove content which they made public using the Social Media services. As part of the agreement the User agrees to refer to all supplemental Privacy Terms and Terms of Use to better understand the User’s, SYMACK’s and third-party rights and obligations in regards to the sharing, and making public to the internet, content on SYMACK’s and third party Social Media services by the User.
As part of the agreement, the User agrees that posting any content directly or indirectly using SYMACK or third-party social media services may be made available to others inside and outside of SYMACK. For this reason, SYMACK urges users to practice vigilance and good judgment when making ANY information publicly available on the World Wide Web (ie, the Internet).
User information collected and processed by SYMACK originates from direct interactions between Users and SYMACK. In addition, SYMACK may also collect information regarding Users indirectly through vendors and third-party partners. When gathering User information through indirect sources, vendors and third-party partners, SYMACK requests vendors to (i) confirm that the information was legally acquired; and (ii) SYMACK can legally obtain and process the User information received from the vendors.
When registering to an event held by SYMACK, SYMACK may collect User information both online and offline in respect to the event. In such events User information is collected during the event and include information such as session participation, surveys and poll interactions. Events held by SYMACK may be recorded and captured using photos. SYMACK reserves the right to use the event videos and photos for promotional use such as, and not limited to, the sharing of videos, images, gathered results of the event on SYMACK’s websites, communications and marketing material. When the User provides SYMACK with business contact information, including the exchange of a business card, SYMACK may use the information to communicate with the User. As part of the Agreement the information SYMACK collects, either directly or indirectly, may be used to help SYMACK improve the SYMACK websites, communications, products or service offerings to better tailor the delivery of SYMACK services to its clients.
SYMACK does not produce nor deliver any third-party advertisements directly on SYMACK’s Websites however, SYMACK does advertise SYMACK related Products and Service Offerings on other Websites and Online Advertising Platforms. For this reason, SYMACK advises users to familiarize themselves with the Privacy Policies and Agreements of the operators and administrators of such platforms, to understand the practices and processes related to advertising and the type of information collected about the User’s Internet usage by the administrators of the advertising platforms discussed herein.
Some of the vendors of Online Advertising Platforms used by SYMACK may be part of the Network Advertising Initiative (NAI) or the European Interactive Digital Advertising Alliance (EDAA). For Vendors that are part of NAI and/or EDAA, Users may opt-out of the Online Advertising material delivered by such vendors by using the tools provided by the following sites:
- Network Advertising Initiative (NAI)
- European Interactive Digital Advertising Alliance (EDAA)
- Digital Advertising Alliance (DAA)
SYMACK has arrangements with third-party service providers to manage SYMACK’s online advertisement on SYMACK and third-party Websites. Such Online Advertisement platforms are designed to collected User information, and may use Cookies as well as Web Beacons to collect certain information (e.g., the User’s IP address, User activities on both SYMACK and third-party Websites). The purpose of collecting User information by the Online Advertisement platforms is to provide Users with targeted advertisements involving SYMACK Products and Service Offerings based on the User’s interests.
If the User would like not to have their information gathered and processed for the purpose of being presented with targeted advertisements by the Online Advertising platforms, the User may opt-out of being served targeted advertisements by visiting the TrustArc website. Please note that the TrustArc opt-out feature does not opt the User out of being presented with non-targeted advertising.
As discussed above, SYMACK participates in the Digital Advertising Alliance program, as a result SYMACK targeted advertisements within Canada and the United States will be identified with the AdChoices icon. Users can click on the icons on the advertisements themselves in order to manage User preferences.
When Users visit SYMACK websites or register for SYMACK Products and Service Offerings, SYMACK may collect information from the User’s interaction(s) in order to assist SYMACK in gathering statistical data to assist in determining the ability of SYMACK to personalize the User Experience, and improve SYMACK’s Products and Service Offerings. SYMACK collects and processes the User information using various technologies, Scripts, Tags, Local Shares Objects (LSO), Local Storage (Dom Objects), Web Beacons, and Cookies.
What are Cookies
Cookies are pieces of data that Websites such as https://www.symack.com may store directly on the User’s computer using their browser. Cookies are categorized as either “Session Cookies” or “Persistent Cookies”.
Session Cookies assist Users in efficient navigation of Websites, track the User’s current progression from page-to-page in order for the Website not to present the User with questions or options already answered by the User if they have previously visited the Website or Webpage. Session Cookies also provide the information required to complete a transaction over a secured and encrypted connection. Session cookies are stored temporarily and erased when the Web Browser is closed.
Unlike Session Cookies, Persistent Cookies store User preferences for current and future interactions with the Website. Session Cookies are written directly on the persistent storage of the User’s device, and remain valid even when the User closes their browser. SYMACK uses Persistent Cookies to record information such as User Localization and Locale.
Cookies provide data used to measure a website’s usage (e.g., number of visitors and duration of each visit) and effectiveness (e.g., most visited pages). Cookies are also used to allow for ease of navigation, and to personalize the Website to a known User by associating the profile information or User preferences. Over a duration of time, the information provides the valuable insight required to improve the User’s experience.
Setting Privacy Preferences and the Use of Cookies
When Users visit SYMACK Websites or Online Services they have the ability to set their preferences when it comes to the use of Cookies and related Technologies through the SYMACK Website’s cookie manager as well as the preferences made available by the Web Browser. By clicking the ‘Cookie Settings’ link at the footer of every SYMACK website the User can choose to Enable or Disable which types of cookies the User would like the SYMACK Websites and Services to use.
Users can find additional information about the types of cookies used by SYMACK Websites and Services and set the User preferences for Strictly Necessary, Performance, and Functional Cookies using the Cookies Settings. Using the SYMACK Cookie Settings functionality does not delete existing cookies stored on he User’s device(s). To delete cookies stored on the User’s device, the User must use the Web Browser’s Cookies and Privacy settings.
SYMACK’s Websites, Communications, Products and Services do not currently support the disabling of tracking mechanisms using “do not track” functionality however, the User can set the privacy preferences and thresholds using the Web Browser settings to limit the use of such cookies and similar technologies.
To limit the type of information stored on the User’s device(s) in the form of Cookies and Beacons, SYMACK urges Users to set the appropriate Cookie Management settings offered by the Web Browser for controlling cookies. Most browsers support the ability to notify Users before a Cookie is stored on the User’s device(s), this allows Users to accept or reject the storing of the Cookies onto their device(s). Since cookies allow Users to take advantage of some of the features and personalizations offered by SYMACK’s Websites, Products and Services, SYMACK recommends Users to leave them turned on at the User’s discretion however, Users can disable the use of Cookies entirely using their Web Browser settings as well as using the SYMACK Cookie Settings functionality to manage the Cookies stored on the User’s device.
Please note if the User blocks, disables and/or rejects SYMACK issued Cookies, some of the SYMACK Web pages may not display or function properly. The User will not be able to use any of SYMACK’s Websites, Products or Services that would require the User to sign in. By disabling Cookies completely the User will also not be able to add items to their SYMACK Shopping Carts or initiate the Checkout process.
Web Beacons and Other Technologies
Some of SYMACK’s Websites, Products and Services may also leverage Web Beacons or other Web based technologies to provide the User with a better customer experience. Such technologies may be in embedded in a number of Web Pages across the SYMACK website. When a User accesses such Web Pages, a non-identifiable event is generated which may be processed by SYMACK or by SYMACK’s Suppliers and Third-Party Vendors.
Web beacons work in conjunction with Cookies, if the User does no want Cookie information to be associated with their Visits to such Web Pages, the User may set their Web Browser as well as the SYMACK Cookie Settings to disable the use of Cookies. By disabling the use of Cookies, Web Beacons and Other technologies may still detect Visits to the Web Pages however, they will not be able to associate the information that would be stored within the Cookies.

SYMACK uses Local Shares Objects (LSO), Local Storage (Dom Objects) to store content information and preferences onto the User’s device(s).
Third party Vendors that SYMACK partners with to provide functionality on SYMACK’s Websites and advertisement also use the same or similar technologies to gather and process User information. To manage Adobe Flash cookies please visit Adobe site.
SYMACK may also include Web Beacons in Marketing Material, Communications, and/or E-Mail Messages in order to determine if the User has opened the messages and clicked on the links when applicable. Some of SYMACK’s Partners and Vendors may also set Web Beacons and Cookies on the SYMACK Web Site. SYMACK also uses third-party technologies and social media buttons to log certain information about the User such as IP Addresses, Date, Time, Locale, Browser Type and referring Website Addresses. If the User is logged into Social Media sites (e.g., LinkedIn, Facebook, Twitter, YouTube or Instagram), such Social Media sites may also link Collected using Cookies and Web Beacons with the User’s profile on the Social Media site. SYMACK encourages Users to review the Privacy Policies of such Social Media Websites.
As part of the Agreement the User acknowledges that SYMACK does not have control over the tracking tools and techniques used by third-party Partners and Vendors. Note that the “https://storage.symack.com” domain used to deliver static content to the User is managed by SYMACK.
The paragraphs below describe in detail how SYMACK may gathered and process User information and how the User information will be used.
User Personalization
SYMACK may gather User information to provide Users with personalized experiences on SYMACK Websites, Communications, Products or Services, such as providing Users with content that the User is interested in and enhancing the navigation on the SYMACK website. SYMACK may also use gathered User information to improve the SYMACK Website experience overall.
Provide User Support
SYMACK may gather Users information to provide Users with support on the various SYMACK products and service offerings that the User has obtained from SYMACK. Such support may include notifications of updates or product fixes. SYMACK may combine User information from various sources or interactions between SYMACK and the User in order to provide Users with proper support. SYMACK may also provide Live and/or Chat Bot capabilities in the SYMACK website to assist Users while navigating the SYMACK Website or Online Forums. SYMACK will also use the User information to provide Users with support in accordance with the Agreement.
In order to provide technical support, SYMACK may create a ticket to track and manage the incident using the information provided by the User. There may be instances while providing technical support that SYMACK will require access to incident related User information (ie, data) located on the User system and/or provided by the User. The User information required by SYMACK when providing support may include (i) information about the User, (ii) information about the Organization the User belongs to, (iii) information regarding the Organization’s employees, customers, partners or vendors. The Agreement between SYMACK and the User regarding the gathering and processing of User information by SYMACK may be supplemented by additional Terms of Use and additional agreements specific to the SYMACK product or service offering.
Provide Marketing Material
User information gathered by SYMACK as well as submitted by the User directly may be used by SYMACK for marketing purposes. SYMACK may provide marketing material to keep Users informed of upcoming SYMACK events, products or services. Prior to providing Users with Marketing Material SYMACK will offer Users the opportunity to choose whether or not SYMACK can process the User information to provide Marketing Material specific to the User. Additionally, Users may at any time choose to opt-out from receiving Marketing Material from SYMACK by (i) following the unsubscribe instructions included in each email communication sent by SYMACK, (ii) request the User information be removed when contacted by a SYMACK representative, or (iii) submitting a request directly to SYMACK using the Contact Us Form.
Some of the SYMACK product, service offerings or events may be a collaboration between SYMACK and third-party vendors, partners and solution providers that resell SYMACK products and services. All co-branded products, service offerings and events will be clearly marketed, indicating all collaborators, partners and sponsors in charge of the event. As part of the Agreement Users acknowledge that User information collected, directly and/or indirectly, while attending events that are a collaboration between SYMACK and its partners or event sponsors will be shared between the sponsors of the event.
SYMACK encourages all Users to familiarize themselves with the privacy policies issued by SYMACK as well as the partners and events sponsors of events held in collaboration with SYMACK.
For SYMACK website pages, communications, products or services where a “Share” functionality exists, SYMACK will ask the User of the name and email address of the individual(s) they would like to share the content with. Upon receiving the required share information, SYMACK will send an e-mail sharing the page with the User’s contact(s).
Perform Transaction Requests
If the User requests access or subscription to SYMACK Products, Services or Events, SYMACK will leverage gathered User information to fulfill User requests. During delivery and fulfillment of SYMACK Products or Services, SYMACK may share the gathered User information with SYMACK’s business partners, shipping companies, financial institutions, government authorities to assist in the delivery of products or services to the User. In order to ensure quality of services delivered to Users, SYMACK may contact Users to take part of SYMACK’s Customer Satisfaction program for market research purposes.
Recruitment
Users may provide SYMACK with information about themselves such as a CV or resume to apply for a job application or inquiry advertised either on a SYMACK website or third-party websites and sources. SYMACK may also process the User information internally within SYMACK to address the User’s general and possible employment inquiries.
If the User has any questions related to the Agreement, please fill out the Contact Us Form. The User’s message will be forwarded to the Privacy Protection Officers or appropriate members at the SYMACK Data Privacy Team. As part of the Agreement and where relevant, and unless indicated otherwise, the controller of User’s personal information is SYMACK Corporation, 115 George St. Suite 140, Oakville ON L6J 0A2. Where SYMACK or affiliate is not established in the European Economic Area (EEA).
SYMACK is not the controller of User private information in situations where:
- The personal information gathered or processed is a result of entering into a contractual relationship with a specific SYMACK affiliate. The controller of User’s personal information in such cases are the SYMACK contracting companies, the legal entity of which the User or the User’s will or has the contract with directly.
- The personal information is collected using a website belonging to one of SYMACK’s affiliates. In such cases the SYMACK affiliate is the controller of the User’s personal information.
Users that have the ability to view, modify or delete their personal information online are advised to contact SYMACK in the event that the User:
- Is unable to access their User information online
- Wish to obtain a copy of the information provided by the User
- Would like SYMACK to correct information submitted by the User which is no longer valid or incorrect
Users that no longer want to receive marketing material from SYMACK are able to submit an opt-out request using the Contact Us Form. Users can also unsubscribe from subscriptions based material sent by SYMACK using email by following the instructions provided at the bottom of each email.
